Cumulative Impacts Rulemaking
Background
In 2019, Senate Bill 19-181 directed the Commission to formally evaluate and address the cumulative impacts of oil and gas operations. Through the 2020 “Mission Change” rulemaking (which went into effect on January 15, 2021), ECMC established the Form 2B (Cumulative Impacts Data Identification) and the Cumulative Impacts Annual Report to help evaluate cumulative impacts and address them through avoidance, minimization, and mitigation measures. In early 2023 ECMC conducted multiple listening sessions to hear feedback from stakeholders. House Bill 23-1294 (signed June 6, 2023) requires the Commission to further evaluate and address cumulative impacts. The Commission opened an informational docket on August 11, 2023, to seek public input; multiple virtual and in-person meetings were held to obtain feedback from stakeholders, including members of Disproportionately Impacted Communities. The Commission is committed to adopting new cumulative impact rules by the required deadline of April 28, 2024.
Rulemaking Timeline
- January 17, 2024 (Hearing) – Initial strawdawg rules are released and a public comment form opened to receive feedback from stakeholders
- January 31, 2024 (Hearing) – The Commission will give direction to Staff on necessary revisions to the strawdawg rules
- Early February 2024 – ECMC will file the Notice of Rulemaking Hearing with the Secretary of State and the revised draft rules will be posted to the Commission’s website
- Planned April 9, 2024 Rulemaking Public Comment Session to be rescheduled (details to come)
- April 22-26 – Commission’s Cumulative Impacts Rulemaking Hearing. Staff will present on April 22
